Scope of Application<\/h2>\n<p>These General Terms and Conditions (GTC) govern the contractual relationship between Old Swiss House AG (hereinafter referred to as \u201cOld Swiss House\u201d or \u201cRestaurant\u201d) and its guests as well as purchasers (hereinafter referred to as \u201cGuest\u201d or \u201cCustomer\u201d).<\/p>\n<p>They apply to all reservations, orders, online purchases, deliveries, and other services of the Restaurant unless otherwise agreed in writing.<\/p>\n<p>Deviating terms of the Guest shall only be recognized if Old Swiss House AG has expressly agreed to them in writing.<\/p>\n<p>By making a reservation, purchase, or using services, the Guest accepts these GTC as binding.<\/p>\n<h2>2. Orders, Invoicing and Payment Terms<\/h2>\n<\/p>\n<ul>\n<li>Orders placed in the Restaurant or via the Old Swiss House AG online shop become binding upon written, electronic, or verbal confirmation by the Restaurant.<\/li>\n<li>All prices are stated in Swiss Francs (CHF), including statutory value-added tax (VAT) according to the applicable Swiss tax rates and including service, unless otherwise stated.<\/li>\n<li>Price changes remain reserved. The valid price is the one displayed at the time the order is placed.<\/li>\n<li>For events or group reservations, Old Swiss House AG may require a deposit or a credit card guarantee.<\/li>\n<li>Invoices are payable immediately upon provision of services. Payments by invoice (if agreed) must be settled within 30 working days from the invoice date. Reminder fees may be charged in case of late payment.<\/li>\n<li>Accepted payment methods include cash (CHF), common credit cards (Visa, Mastercard, American Express), and other indicated electronic payment methods.<\/li>\n<li>The Guest may only offset claims that are undisputed or legally established.<\/li>\n<\/ul>\n<h2>3. Delivery<\/h2>\n<\/p>\n<ul>\n<li>Old Swiss House AG offers deliveries exclusively within Switzerland and Liechtenstein.<\/li>\n<li>Delivery times are indicative only and non-binding unless expressly confirmed in writing. Old Swiss House AG accepts no liability for delays caused by force majeure or external circumstances.<\/li>\n<li>Delivery is made to the address provided by the Customer. If the recipient cannot be reached, a notification will be left. Any additional costs resulting from unsuccessful delivery attempts shall be borne by the Customer.<\/li>\n<\/ul>\n<h2>4. Warranty and Guarantee<\/h2>\n<\/p>\n<ul>\n<li>Old Swiss House AG warrants that its products and services comply with the quality standards applicable at the time of delivery or performance.<\/li>\n<li>For sold goods (e.g., online shop items), the statutory warranty periods pursuant to the Swiss Code of Obligations (CO) apply. Warranty services may be supplemented by the respective manufacturer\u2019s guarantees where applicable.<\/li>\n<li>Warranty claims are excluded in cases of improper handling or use.<\/li>\n<\/ul>\n<h2>5. Liability<\/h2>\n<h3>5.1 Liability of the Restaurant<\/h3>\n<\/p>\n<ul>\n<li>Old Swiss House AG excludes liability to the extent permitted by law for slight and ordinary negligence and shall only be liable for damages caused intentionally or through gross negligence.<\/li>\n<li>Old Swiss House AG is liable for guests\u2019 property brought onto the premises only in accordance with statutory provisions. No liability is accepted for slight or ordinary negligence.<\/li>\n<li>In particular, any liability for theft or damage to materials brought in by third parties is excluded.<\/li>\n<\/ul>\n<h3>5.2 Liability of the Guest<\/h3>\n<p>The Guest shall be liable towards Old Swiss House AG for all damages and losses caused by the Guest, accompanying persons, or event participants, without the Restaurant being required to prove fault.<\/p>\n<h2>6. Returns, Exchanges and Acceptance of Returns<\/h2>\n<p>Returns are permitted exclusively after prior written agreement with Old Swiss House AG. Return shipping costs shall be borne by the Customer unless expressly agreed otherwise.<\/p>\n<h2>7. Data Protection<\/h2>\n<\/p>\n<ul>\n<li>Old Swiss House AG processes personal data exclusively in accordance with applicable data protection regulations, in particular the Swiss Federal Act on Data Protection (FADP) and \u2013 where applicable \u2013 the General Data Protection Regulation (GDPR).<\/li>\n<li>Collected data (e.g., name, address, payment information, email) are used solely for contract processing, customer service, and \u2013 where the Guest has consented \u2013 marketing purposes.<\/li>\n<li>The transmission of sensitive data, in particular payment information, takes place exclusively via encrypted connections (SSL\/TLS technology). Credit card data are not stored permanently and are processed exclusively via certified payment service providers.<\/li>\n<li>Personal data will only be disclosed to third parties where necessary for contract performance (e.g., delivery services, payment providers) or where required by law.<\/li>\n<li>The Guest has the right to information, correction, deletion, and restriction of processing of personal data. Requests must be submitted in writing to <a href=\"mailto:restaurant@oldswisshouse.ch\">restaurant@oldswisshouse.ch<\/a>.<\/li>\n<\/ul>\n<h2>8. Applicable Law and Jurisdiction<\/h2>\n<\/p>\n<ul>\n<li>These GTC and all legal relationships arising from them shall be governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).<\/li>\n<li>The exclusive place of jurisdiction for all disputes arising out of or in connection with these GTC or the services of Old Swiss House AG shall be Lucerne, Switzerland.<\/li>\n<li>Mandatory statutory jurisdictions, particularly under consumer protection law, remain reserved.<\/li>\n<\/ul>\n<h2>Final Provisions<\/h2>\n<p>Should individual provisions of these GTC be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.<\/p>\n<p>Old Swiss House AG reserves the right to amend these GTC at any time. The current version is available at www.oldswisshouse.ch.
